9/28/2020 City Council Meeting Minutes

COMMON COUNCIL
September 28, 2020

 The Common Council met in a regular meeting on September 28, 2020, at the Frankfort Community Public Library, 208 West Clinton Street, Frankfort, Indiana at 7:00 PM.

Mayor Judy Sheets called the meeting to order and led the assembly in the Pledge of Allegiance. Upon roll call, the following members were present: Mayor Judy Sheets, Brandt Fuller, Joe Palmer, Megan Sheets, Clarence Warthan, Steve Beardsley, Michael Brite, and Eric Woods. Also present was Clerk-Treasurer Carol Bartley and City Attorney Les Bergum.

MINUTES:   The minutes for the September 14, 2020, regular meeting were presented. Councilmember Beardsley moved for the minutes to be approved seconded by Councilmember Palmer. Upon roll call vote, six ayes and one abstention were recorded. Motion passed 6-0.

PUBLIC COMMENTS:  None

ORDINANCE 20-18: AN ORDINANCE AMENDING THE WASTEWATER ADMISSIBILITY STANDARDS.

Councilmember Woods made a motion to pass ordinance 20-18 on the second reading seconded by Councilmember Fuller.  Upon roll call vote, seven ayes were recorded. Motion passed 7-0.

ORDINANCE 20-19: AN ORDINANCE AUTHORIZING THE ACQUISITION, CONSTRUCTION AND INSTALLATION OF CERTAIN IMPROVEMENTS TO THE WATERWORKS SYSTEM OF THE CITY OF FRANKFORT, INDIANA, THE ISSUANCE OF REVENUE BONDS TO PROVIDE FOR THE COST THEREOF, THE COLLECTION, SEGREGATION AND DISTRIBUTION OF THE REVENUES OF SUCK SYSTEM, THE SAFEGUARDING OF THE INTERESTS OF THE OWNERS OF SUCH REVENUE BONDS AND OTHER MATTERS CONNECTED THEREWITH, INCLUDING THE ISSUANCE OF NOTES IN ANTICIPATION OF SUCH BONDS, AND REPEALING ORDINANCES INCONSISTENT HEREWITH.

Rich Starkey from Barnes and Thornburg discussed with the council that the ordinance has been amended to include references to the 2016 water bonds. Councilmember Palmer made a motion to pass ordinance 20-19 on the second reading as amended. Motion was seconded by Councilmember Sheets.  Upon roll call vote, seven ayes were recorded. Motion passed 7-0.

RESOLUTION 20-17: A RESOLUTION APPROVING CONTRACT FOR PURCHASE OF REAL ESTATE

Councilmember Beardsley made a motion to pass resolution 20-17 seconded by Councilmember Fuller. Upon roll call vote, six ayes and one abstention were recorded.  Motion passed 6-0.

OLD BUSINESS:
Mayor Sheets informed the council that Carol Bartley has put out the advertisement for the council appointed Utility Service Board member.  As the current term ends on September 30th, the current board member will hold that position until a new member has been appointed.

Mayor Sheets announced that she would be appointing Kent Brewer to the Utility Service Board for another term.

NEW BUSINESS:

ORDINANCE 20-20: AMENDMENT OF ORDINANCE NO. 18-05

Councilmember Woods made a motion to read ordinance 20-20 by title only, seconded by Councilmember Beardsley.  Upon roll call vote, seven ayes were recorded.  Motion passed 7-0.

Les Bergum informed the council that the ordinance is to amend the effective date of ordinance 18-05 from August 27, 2018 to August 28, 2018 in order to ensure proper zoning as originally intended.

Councilmember Woods made a motion to suspend the rules and pass ordinance 20-20 on all three readings, seconded by Councilmember Warthan.  Upon roll call vote, seven ayes were recorded.  Motion passed 7-0.

Councilmember Beardsley made a motion to pass ordinance 20-20 on all three readings, seconded by Councilmember Palmer.  Upon roll call vote, seven ayes were recorded.  Motion passed 7-0.

ADJOURNMENT:   There being no further business to come before the Council, Councilmember Palmer moved to adjourn seconded by Councilmember Woods. Mayor Sheets adjourned the meeting at 7:13 PM.
