The Frankfort City Board of Zoning Appeals met at a Special Meeting on May 20, 2020, in the Council Chambers, 301 E Clinton Street, Frankfort, Indiana at 5:30 p.m. The meeting was also presented and attended via GoToMeeting.

President Kevin Myers was present and called the meeting to order. Upon roll call, the following members were present: Richard Greeno, Isac Chavez (virtually), and David Hussey. Also present: Staff members Susan Palmer, Ashlee Bassett, Daniel Howe, Annie Bacon, Don Stock, and City Attorney Les Bergum.

MINUTES: Minutes of April 15, 2020 meeting were presented. Richard Greeno made a motion to approve minutes as presented. David Hussey seconded the motion. Upon roll call, four “ayes” were recorded. Motion carried, minutes approved.

Docket # 2020-04   Brenda Timmons: Mark Timmons, representing Brenda Timmons, is present and requests a Variance of Developmental Standards for 1054 Delphi Ave. The petitioner asks for a Variance to City Zoning Code Appendix A: Residential Use and Requirements. Specifically, the petitioner asks for approval to allow an attached garage to be constructed at two feet from the property sideline instead of the required five-foot setback. Mark Timmons states he will be building a 16’x40’ attached garage. He will also be doing a home addition to the rear of the property but that does not affect this meeting. 16’x16’ of this addition will be a patio, 16’x24’ will be the garage. Work will be completed by himself. He hopes to have all 1,400 sq. ft. under roof by this winter. Don Stock presented staff report & findings of fact. He notes that appropriate letters were mailed out and no grievances were received. He asks if the Variance is only good for twelve months once approved. Richard Greeno says once it’s approved, it will stay with the property and there is no expiration. President Myers opened Public Hearing for comments from interested parties. Hearing nothing, Public Hearing was closed. President Myers noted that appropriate letters were mailed out to property owners within 100 feet and advertisement was listed in Frankfort Times. President Myers called for board discussion regarding Variance of Developmental Standards, or if none was to be had, he would entertain a motion to accept/ deny Variance. David Hussey asked for clarification on side line setback. Mark Timmons states he hired Ron Weary to come out and do survey of land but it was never completed. He was unsure of exactly how far away from property line he would be and thought it would be closer to four feet from line, but wanted to ask for two to make sure he was okay in case it was closer. David Hussey asks that in our motion we clarify that the Variance is for four feet instead of two. Richard Greeno made a motion to approve the Variance of Developmental Standards as stated with four foot setback with the five findings of fact. David Hussey seconded the motion. Upon roll call, four “ayes” recorded. Motion passed. Variance of Developmental Standards approved.

Docket # 2020- 05 CJ Investments: Jonathan Jura, owner/ representative for CJ Investments is available via GoToMeeting and requests a Use Variance for 552 S Columbia St. The petitioner asks for a Variance to City Zoning Code Appendix A: Residential Use and Requirements. Specifically, the petitioner asks for approval to allow an existing four-unit dwelling to continue in the “C” Residential Zoning District. President Myers asks petitioner to speak on this. Jonathan states that he originally bought the property from Waggoners and it was out of compliance. It was a five unit dwelling when he bought it and he removed one unsafe unit, to make it a four unit dwelling. He states they have since replaced all the electrical/ plumbing and basically did a total remodel of the property. President Myers opened Public Hearing for comments from interested parties. President Myers noted that appropriate letters were mailed out to property owners within 100 feet and advertisement was listed in Frankfort Times. President Myers called for board discussion regarding Variance of Developmental Standards, or if none was to be had, he would entertain a motion to accept/ deny Variance. David Hussey asks petitioner how long he has owned property. Jonathan Jura states he has owned it since 2018. Don Stock presented staff report & findings of fact. Richard Greeno asked how many bedrooms each unit had. Petitioner states there are two- two bedroom units upstairs and two-two bedroom units downstairs. He states that his company is very thorough and utilizes credit and background checks for every applicant, stating that they want good tenants in their properties. President Myers closed the Public Hearing. Richard Greeno made a motion to approve the Use Variance with the findings of fact. Motion seconded by Kevin Myers. Upon roll call three “ayes” were recorded, one “nay” David Hussey. Motion passed. Use Variance approved.

With no further business, meeting is adjourned.
