4/13/2020 City Council Meeting Minutes

COMMON COUNCIL
April 13, 2020

The Common Council met in a regular meeting on April 13, 2020, in the Council Chambers, 301 East Clinton Street, Frankfort, Indiana at 7:00 PM.  The meeting was also presented and attended via GoToMeeting.

Mayor Judy Sheets called the meeting to order and led the assembly in the Pledge of Allegiance. Upon roll call, the following members were present via GoToMeeting or in-person:   Mayor Judy Sheets, Eric Woods, Clarence Warthan, Brandt Fuller, Steve Beardsley, Michael Brite, Megan Sheets, and Joe Palmer. Also present: Les Bergum, City Attorney, Clerk-Treasurer Carol Bartley and Cheryl Martin, Payroll Deputy/HR Coordinator was present to record the minutes.

MINUTES:   The minutes for the March 9, 2020, regular meeting were presented. Councilmember M. Sheets made a motion to approve the minutes for the March 9, 2020 meeting amended to say “Minutes of the February 27, 2020, Council meeting approved” not the March 2, 2020 minutes. Councilmember Palmer seconded the motion. Upon roll call vote seven “ayes” were recorded. Motion passed.

PUBLIC COMMENTS:    There were no public comments.

ORDINANCE 20-03: AN ORDINANCE ESTABLISHING RULES AND REGULATIONS FOR PARKS AND OTHER RECREATIONAL AREAS IN THE CITY OF FRANKFORT, INDIANA.  Councilmember Woods made a motion to approve Ordinance 20-03.  Councilmember Fuller seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Motion passed on third and final reading.

ORDINANCE 20-06: AN ORDINANCE AMENDING ORDINANCE NO. CO-75-10 REGARDING UTILITY SERVICE BOARD. Councilmember Warthan made a motion to approve Ordinance 20-06.  Councilmember M. Sheets seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Motion passed on third and final reading.

ORDINANCE 20-10: AN ORDINANCE AUTHORIZING AND APPROVING CERTAIN ACTIONS AND DOCUMENTS IN CONNECTION WITH THE TAX REISSUANCE OF CITY OF FRANKFORT, INDIANA ECONOMIC DEVELOPMENT REVENUE MULTIPURPOSE BONDS, SERIES 2012 (WESLEY MANOR, INC. PROJECT). Councilmember Woods made a motion to read Ordinance 20-10 by title only. Councilmember Palmer seconded the motion.  Upon roll call seven “ayes” were recorded. Motion passed

Discussion followed.  Per City Attorney Les Bergum, these are revenue bonds only. There is no obligation by the City.  Attorney Jerimi Ullom of Hall, Render, Killian, Heath & Lyman, P.C. has asked that it be passed tonight on the first, second and third readings.  Councilmember Warthan asked what the purpose of the changes are to this ordinance.  Mr. Bergum stated it is to extend the date on bond and includes a reduced rate adjustment.

Councilmember Warthan moved to pass ordinance 20-10 on all three readings.  Councilmember Fuller seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Motion passed.

Councilmember Palmer made a motion to approve Ordinance 20-10.  Councilmember   Warthan seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Motion passed on first, second and third readings.

RESOLUTION 20-05: A RESOLUTION TRANSFERRING FUNDS FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUND TO THE CITY GENERAL in the amount of $30,518.90. Councilmember Woods made a motion to approve Resolution 20-05.  Councilmember M. Sheets seconded the motion. Councilmember Woods suggested making this an automatic transfer every year.  Mr. Bergum will look into this.  Upon roll call vote seven “ayes” were recorded.  Motion passed.

RESOLUTION 20-06: A RESOLUTION DIRECTING TRANSFER OF APPROPRIATED FUNDS AMENDING ORD. NO. CO-75-10 REGARDING USB. Councilmember Warthan made a motion to approve Resolution 20-06.  Councilmember   Palmer seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Motion passed.

RESOLUTION 20-0: A RESOLUTION DELAYING TPA AQUATIC CENTER PROJECT. Councilmember M. Sheets moved to read Resolution 20-07 in its entirety.  Councilmember Brite seconded. Upon roll call vote seven “ayes” were recorded.  Motion passed.

Clerk-Treasurer Carol Bartley read the Resolution in its entirety for the record.

Councilmember Palmer made a motion to approve Resolution 20-07.  Councilmember Brite seconded the motion.  Mayor Sheets stated the finance committee has discussed this.  Mrs.  Bartley stated the Local Income Tax revenue will be impactful in the year 2022.  The city could receive a loss in those funds due to current unemployment. Also, the 60-day extension to the due date of property tax payments will impact this.  Councilmember Woods stated as finance committee member, that no one can anticipate the hardships we will see and it was a tough decision but absolutely necessary. Councilmember Beardsley stated this is an unprecedented time and no one can predict what will happen in the near future and it would be irresponsible to continue with this now, but he is fully behind it to be undertaken in the future. City Attorney Bergum thanked finance the committee and the Administration for their due diligence on this.  April 26, 2020, is the deadline to award the bid by the Board of Works and they needed guidance on this.  After April 26th the bids will need to be advertised again after that date. At that time those bids could be higher or even lower.  Mayor Sheets stated this could be revisited every three months and is fiscally responsible.    Upon roll call vote seven “ayes” were recorded.  Motion passed

OLD BUSINESS:   Councilmember M. Sheets stated the contract with Travis Sheets has been terminated by the Board of Works.  The contract is to now expire May 31, 2020, instead of 2021.

NEW BUSINESS:  Councilmember Palmer stated $75,000.00 is appropriated every year by the Rural Development Commission for the façade grant has been put on hold and is to be directed to emergency relief to small businesses in the TIF District. This will be paid through TIF dollars.

Mayor Sheets thanked everyone for the efforts in this trying time

ADJOURNMENT:   There being no further business to come before the Council, Councilmember Palmer moved to adjourn and Council member Fuller seconded the motion. Mayor Sheets adjourned the meeting at 7:33 p.m.
