10/28/2019 City Council Meeting Minutes

COMMON COUNCIL

October 28, 2019

The Common Council met in a regular meeting on October 28, 2019, in the Council Chambers, 301 East Clinton Street, Frankfort, Indiana at 7:00 PM.

Mayor Chris McBarnes called the meeting to order and led the assembly in the Pledge of Allegiance.  Mayor McBarnes then prayed. Upon roll call, the following members were present:  Jim Moyer, Eric Woods, Clarence Warthan Steve Beardsley, Lewis Wheeler, David Hussey, and Joe Palmer.  Also present: Judith Sheets, Clerk-Treasurer and Les Bergum, City Attorney.

MINUTES:   The minutes for the October 14, 2019 regular meeting were presented.  Joe Palmer made a motion to approve the minutes for the October 14,2019 meeting.  Jim Moyer seconded the motion.  Upon roll call vote five “ayes” – Eric Woods, Joe Palmer, Clarence Warthan, Steve Beardsley, Jim Moyer and two “abstains” – David Hussey, Lewis Wheeler were recorded.   Motion passed.

PUBLIC COMMENTS:   The Clinton Central Elementary School Robotic Team was present at the meeting.   Mr. Jim McCarter presented information on the Robotic Team and stated that he was the first Lego League Robotics coach at Clinton Central.  Members of the Robotic Team were also present to provide information on a project that had been working on to revitalize the Roundhouse and the area around it.

ORDINANCE 19-13:   ORDINANCE FOR APPROPRIATIONS AND TAX RATES.  Jim Moyer made a motion to pass Ordinance 19-13 on the Third Reading.  Clarence Warthan seconded the motion.  Upon roll call vote six “ayes” – Eric Woods, David Hussey, Joe Palmer, Clarence Warthan, Steve Beardsley, Jim Moyer and one “abstain” – Lewis Wheeler.   Ordinance 19-13 passed on the Third Reading.

ORDINANCE 19-14:   AN ORDINANCE SETTING THE SALARIES AND HOURLY WAGES FOR EMPLOYEES OF THE CIVIL CITY OF FRANKFORT, INDIANA.  Joe Palmer made a motion to pass Ordinance 19-14 on the Third Reading.  Eric Woods seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Ordinance 19-14 passed on the Third Reading.

ORDINANCE 19-15:   AN ORDINANCE ESTABLISHING THE SALARIES OF THE ELECTED OFFICIALS OF THE CITY OF FRANKFORT, INDIANA.  Eric Woods made a motion to pass Ordinance 19-15 on the Third Reading.  Joe Palmer seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Ordinance 19-15 passed on the Third Reading.

ORDINANCE 19-18:   AN ORDINANCE AMENDING CHAPTER 71 OF THE MUNICIPAL CODE TO AUTHORIZE REGULATION OF TRAFFIC IN RESIDENTIAL COMPLEXES.  Steve Beardsley made a motion to pass Ordinance 19-18 on the Third Reading.  Jim Moyer seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Ordinance 19-18 passed on the Third Reading.

Mayor McBarnes recessed the Council meeting at 7:21 PM and opened the Public Hearing on Ordinance 19-19.   Mayor McBarnes stated that this is an additional appropriation for Health Insurance and that the additional appropriation is for $450,000 in Rainy Day.

There were no public comments.

Mayor McBarnes closed the Public Hearing at 7:23 PM and reopened the council meeting.

ORDINANCE 19-19:    ADDITIONAL APPROPRIATION ORDINANCE 19-19.  Joe Palmer made a motion to suspend the rules and pass Ordinance 19-19 on the Second and Third Reading.  David Hussey seconded the motion.  Upon roll call vote six “ayes” – Eric Woods, David Hussey, Joe Palmer, Clarence Warthan, Steve Beardsley, Jim Moyer, and one “abstain” – Lewis Wheeler.

Motion passed.   Joe Palmer made a motion to pass Ordinance 19-19 on the second and third reading.  David Hussey seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Ordinance 19-19 passed on the second and third reading.

Mayor McBarnes recessed the Council meeting 7:26 PM and opened the Public Hearing on Resolution 19-24.   Mayor McBarnes stated that this is for Pennington Holdings and Backstep Brewing Company requesting a vacant building tax abatement.

David Riggs, 957 East Wabash Street asked about the parking.   It was stated that the church next to the building would eventually torn down and that is where there would be parking.  Jay Moore stated that a notice had been published and information distributed to the taxing units affects.

Mayor McBarnes closed the Public Hearing and reopened the council meeting at 7:30 PM.

RESOLUTION 19-24:   Joe Palmer made a motion to pass Resolution 19-24.  Steve Beardsley seconded the motion.  Lewis Wheeler asked if this property had to be 500 feet from the church.  Patrick Pennington stated that as a brewery it has to be 250 feet and he is the owner of the church and it will be taken down.  Upon roll call vote five “ayes” – Eric Woods, Joe Palmer, Clarence Warthan, Steve Beardsley, Jim Moyer, one “abstain” – David Hussey, one “nay” – Lewis Wheeler.   Resolution 19-24 passed.

Mayor McBarnes recessed the council meeting at 7:35 PM and opened the Public Hearing on Resolution 19-25.   Mayor McBarnes stated this is the confirming resolution for Richey & Sons who are purchasing the former Tech Group building which has been vacant.

There were no public comments.

Mayor McBarnes closed the Public Hearing at 7:36 PM and reopened the Council meeting.

RESOLUTION 19-25:     RESOLUTION APPROVING STATEMENTS OF BENEFITS AND CONFIRMING DESIGNATION OF AN ECONOMIC REVITALIZATION AREA AND AN ELIGIBLE VACANT BUILDING.   David Hussey made a motion to pass Resolution 19-25.  Clarence Warthan seconded the motion.   Upon roll call vote six “ayes” – Eric Woods, David Hussey, Joe Palmer, Clarence Warthan, Steve Beardsley, Jim Moyer and one “abstain” – Lewis Wheeler.   Resolution 19-25

OLD BUSINESS:   There was discussion on the Not for Profit funding for 2020.  Judy Sheets stated that her office had received one application so far asking for funding for 2020.  Eric Woods suggest advertising for the Not for Profit funds and give them 30 days to apply.   Eric Woods made a motion that for one year the deadline is changed to November 29 by 4:00 PM to receive applications for funding for the Not for Profit.   Steve Beardsley seconded the motion.  Upon roll call vote seven “ayes” were recorded.   Motion passed.

Clarence Warthan asked about the advertising for the Utility Service Board position.  Judy Sheets stated that it was advertised on October 24th and will be advertised again on October 31st with the deadline being November 6th noon to turn in resumes.

NEW BUSINESS:    Lewis Wheeler thanked the City for their support of the Jack O Lantern Jamboree sponsored by the Frankfort United Neighborhood.  Lewis stated that over 2000 showed up.

ADJOURNMENT:   There being no further business to come before the Council, Jim Moyer made a motion to adjourn.   Joe Palmer seconded the motion.  Mayor McBarnes adjourned the meeting.
