9/9/2019 Common Council Meeting Minutes

The Common Council met in a regular meeting on September 9, 2019, in the Council Chambers, 301 East Clinton Street, Frankfort, Indiana at 7:00 PM.

Mayor Chris McBarnes called the meeting to order and led the assembly in the Pledge of Allegiance.  David Hussey then prayed. Upon roll call, the following members were present:  Eric Woods, Clarence Warthan, Steve Beardsley, Lewis Wheeler, David Hussey, and Joe Palmer. Also present: Judith Sheets, Clerk-Treasurer and Les Bergum, City Attorney.  Absent:  Jim Moyer.

MINUTES:   The minutes for the August 12, 2019, regular meeting were presented.  Joe Palmer made a motion to approve the minutes for the August 12, 2019 meeting.   Eric Woods seconded the motion.  Upon roll call vote five  “ayes” Eric Woods, Joe Palmer, Clarence Warthan, Steve Beardsley, Lewis Wheeler and one “abstain” – David Hussey were recorded.   Motion passed.

PUBLIC COMMENTS:   David Riggs, 957 East Wabash Street, stated that he thought there was a homeless problem in Frankfort.   David stated that there are people sleeping at the gazebo downtown.   David stated that he was interested in finding ways to fund tiny houses.

Brandt Fuller stated that he had a heart attack last week and that he would like to thank Fire Chief John Kirby and his crew along with the EMS.   Chief Kirby stated that Greg Miller and Toby Boyer were the ones on the call and he would let them know.

ORDINANCE 19-09:    AN ORDINANCE AMENDING AND RESTATING SECTION 96.06 OF THE FRANKFORT MUNICIPAL CODE REGARDING LOUD, UNNECESSARY OR UNUSUAL NOISE.   Steve Beardsley made a motion to pass Ordinance 19-09 on the Third Reading.  Clarence Warthan seconded the motion.  Upon roll call vote six “ayes” were recorded.  Ordinance 19-09 passed on the Third Reading.

ORDINANCE 19-10:   AN ORDINANCE AMENDING AND RESTATING SECTION 130.03 REGARDING ALCOHOLIC BEVERAGES IN CITY PARKS OR PROPERTY.  Joe Palmer made a motion to pass Ordinance 19-10 on the Second Reading.  Eric Woods seconded the motion.  Upon roll call vote four “ayes” – Eric Woods, Joe Palmer, Clarence Warthan, Steve Beardsley and two “nays” – David Hussey, Lewis Wheeler.    Ordinance 19-10 passed on the Second Reading.

ORDINANCE 19-11:   AN ORDINANCE AMENDING ZONING MAP.  Steve Beardsley made a motion to pass 19-11 on the Second Reading.  Joe Palmer seconded the motion.  Lewis Wheeler stated that the City Plan Commission had recommended that the property for the Frankfort Cottages be rezoned from Reserved Business to “D” Residential.  Discussion followed.  Upon roll call vote six “ayes” were recorded.  Ordinance 19-11 passed on the Second Reading.

ORDINANCE 19-12:    ADDITIONAL APPROPRIATION ORDINANCE.  Eric Woods made a motion to read Ordinance 19-12 by title only.  Steve Beardsley seconded the motion.  Upon roll call vote six “ayes” were recorded.  Ordinance 19-12 was read by title only.  Mayor McBarnes stated that this additional appropriation would be used for HWC Engineering for the new pool and that it would be reimbursed when the pool bond is issued.  Joe Palmer made a motion to pass Ordinance 19-12 on the First Reading.  Clarence Warthan seconded the motion.   Mayor McBarnes stated that we need to hire the engineering firm and that a lot of work can be done in two weeks.  Discussion followed.  Joe Palmer and Clarence Warthan withdrew the motion.  Joe Palmer made the motion to suspend the rules and pass Ordinance 19-12 on the First, Second, and Third Reading.  Clarence Warthan seconded the motion.  Upon roll call vote five “ayes” – Eric Woods, David Hussey, Joe Palmer, Clarence Warthan, Steve Beardsley and one “nay” – Lewis Wheeler.  Motion did not pass.  Joe Palmer made a motion to pass Ordinance 19-12 on the First Reading.  Clarence Warthan seconded the motion.  Upon roll call vote six “ayes” were recorded.  Ordinance 19-12 passed on the First Reading.

OLD BUSINESS:   There was no old business.

NEW BUSINESS:    Steve Beardsley talked about funds for the professional services for annexation.  Steve stated that there are funds from the Washington Avenue project that could be transferred for the annexation professional services.  Discussion followed.   Mayor McBarnes stated that the amount is $137,000.  Steve Beardsley made a motion that the funds earmarked for the Washington Avenue Project for $137,000 in EDIT be transferred for annexation professional services.  Joe Palmer seconded the motion.   Upon roll call vote six “ayes” were recorded.  Motion passed.

ADJOURNMENT:   There being no further business to come before the Council, Joe Palmer made a motion to adjourn.  David Hussey seconded the motion.  Mayor McBarnes adjourned the meeting.
