8/12/2019 Common Council Meeting Minutes

The Common Council met in a regular meeting on August 12, 2019, in the Council Chambers, 301 East Clinton Street, Frankfort, Indiana at 7:00 PM.

Mayor Chris McBarnes called the meeting to order and led the assembly in the Pledge of Allegiance.  Clarence Warthan then prayed. Upon roll call, the following members were present:   Jim Moyer, Eric Woods, Clarence Warthan, Steve Beardsley, Lewis Wheeler, and Joe Palmer.  Also present: Judith Sheets, Clerk-Treasurer and Les Bergum, City Attorney.  Absent:  David Hussey.

MINUTES:   The minutes for the July 22, 2019, regular meeting were presented. Clarence Warthan made a motion to approve the minutes for the July 22, 2019 meeting.  Joe Palmer seconded the motion.  Upon roll call vote four “ayes” Eric Woods, Joe Palmer, Clarence Warthan, Steve Beardsley and two “abstain” – Jim Moyer, Lewis Wheeler were recorded.   Motion passed.

PUBLIC COMMENTS:   There were no public comments.

ORDINANCE 19-09:    AN ORDINANCE AMENDING AND RESTATING SECTION 96.06 OF THE FRANKFORT MUNICIPAL CODE REGARDING LOUD, UNNECESSARY OR UNUSUAL NOISE.  Eric Woods made a motion to pass Ordinance 19-09 on the Second Reading.  Steve Beardsley seconded the motion.  Upon roll call vote six “ayes” were recorded.  Ordinance 19-09 passed on Second Reading.

ORDINANCE 19-11:   AN ORDINANCE AMENDING ZONING MAP.   Joe Palmer made a motion to read Ordinance 19-11 by title only.  Clarence Warthan seconded the motion.   Upon roll call vote six “ayes” were recorded.  Motion passed.  Ordinance 19-11 was read by title only.   Alicia Albertson stated that this was for rezoning for the Ellipsis Frankfort Senior Living from Reserved Business to “D” Residential.   Lewis Wheeler stated that the City Plan Commission had voted to recommend this to the Council.  Les Bergum stated because of the special exception this will go before the Board of Zoning.    Discussion followed.  Steve Beardsley made a motion to pass Ordinance 19-11 on the First Reading.  Joe Palmer seconded the motion.  Upon roll call vote six “ayes” were recorded.  Ordinance 19-11 passed on the First Reading.

ORDINANCE 19-10:   AN ORDINANCE AMENDING AND RESTATING SECTION 130.03 REGARDING ALCOHOLIC BEVERAGES IN CITY PARKS OR PROPERTY.  Eric Woods made a motion to read Ordinance 19-10 in its entirety.  Steve Beardsley seconded the motion.  Upon roll call vote six “ayes” were recorded.   Ordinance 19-10 was read in entirety.  Annie Bacon, Community Development Director, stated that this is proposing a change to City Parks and property concerning alcohol.  Clarence Warthan asked if at Prairie Creek Park this would be in the Beer Garden.  Annie stated that the Board of Works could approve if confined to a specific space.  Joe Palmer made a motion to pass Ordinance 19-10 on the First Reading.  Jim Moyer seconded the motion.   Lewis Wheeler stated that he is not a fan of this ordinance and that he will not support it.  Upon roll call vote five “ayes” – Eric Woods, Joe Palmer, Clarence Warthan, Steve Beardsley, Jim Moyer and one “nay” – Lewis Wheeler.  Ordinance 19-10 passed on the First Reading.

RESOLUTION 19-18:   A RESOLUTION ESTABLISHING THE PRAIRIE CREEK PARK FESTIVAL AND EVENT FUND.   Travis Sheets, Parks Superintendent and Judy Sheets, Clerk-Treasurer talked about the fund and that donations and sponsorships for Prairie Creek Park festivals and events would be deposited in this fund.   Judy stated that the Parks Superintendent would be the one to determine how the funds are spent.  Joe Palmer made a motion to pass Resolution 19-18.  Eric Woods seconded the motion.  Upon roll call vote six “ayes” were recorded.   Resolution 19-18 passed.

OLD BUSINESS:   Mayor McBarnes stated that the second council meeting in August has been cancelled.   Jim Moyer reported on the Budget Hearings that were held earlier in the day.

NEW BUSINESS:    The CF-1 for Wesley Manor Southside.  This CF-1 had been sent to the County Auditor and then she forwarded it to the City for approval.  Les Bergum stated that the form says it is to be filed with the County Auditor by May 15th and that deadline was met.   Eric Woods made a motion to approve the CF-1 for Wesley Manor Southside.  Clarence Warthan seconded the motion.  Upon roll call vote six “ayes” were recorded.  Motion passed.

ADJOURNMENT:   There being no further business to come before the Council, Jim Moyer made a motion to adjourn.  Joe Palmer seconded the motion.  Mayor McBarnes adjourned the meeting.
