Common Council Meeting Minutes – April 8, 2019

The Common Council met in a regular meeting on April 8, 2018 in the Council Chambers, 301 East Clinton Street, Frankfort, Indiana at 7:00 PM.

Mayor Chris McBarnes called the meeting to order, and led the assembly in the Pledge of Allegiance.   David Hussey then prayed. Upon roll call the following members were present:   Jim Moyer, Eric Woods, Clarence Warthan, Steve Beardsley, Joe Palmer, David Hussey and Lewis Wheeler.  Also present: Judith Sheets, Clerk-Treasurer and Les Bergum, City Attorney.

MINUTES:   The minutes for the March 25, 2019 regular meeting were presented.  David Hussey made the motion to approve the minutes from the March 25, 2019 regular meeting.   Jim Moyer seconded the motion.  Upon roll call vote six “ayes” – David Hussey, Joe Palmer, Clarence Warthan, Steve Beardsley, Lewis Wheeler, Jim Moyer and one “abstain” – Eric Woods were recorded.   Motion passed.

 PUBLIC COMMENTS:   There were no Public Comments.

ORDINANCE 19-05:     AN ORDINANCE AMENDING SECTION 96.26 OF THE MUNICIPAL CODE.   Steve Beardsley made a motion to read Ordinance 19-05 by title only.  Joe Palmer seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Motion passed.  Ordinance 19-05 was read by title only.  Police Chief Troy Bacon stated that since Code Enforcement is now at the police department there are some ordinances that need changed.  Chief Bacon stated that Section 96.26 of the municipal code needs to be changed so code enforcement can enforce it.   Chief Bacon stated that it was changed from 10 days to 5 days from the date of notice to correct.  Chief Bacon stated that the notices will be sent by certified mail, regular mail or hand delivered.  Chief Bacon stated that 9 out of 10 of the notices will be hand delivered.  Mayor McBarnes stated that we are not paying the contractors to mow and paying the $35 per cut and that the Street Department will not do the mowing.   Eric Woods made a motion to pass Ordinance 19-05 on the First Reading.  David Hussey seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Ordinance 19-05 passed on the First Reading.

ORDINANCE 19-06:     AN ORDINANCE AMENDING SECTION 96.27 OF THE MUNICIPAL CODE.   Jim Moyer made a motion to read Ordinance 19-06 by title only.  Clarence Warthan seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Motion passed.   Ordinance 19-06 was read by title only.   Police Chief Troy Bacon stated that the Street Department will be doing the mowing.  Chief Bacon stated that it was changed to the police department from the building inspector’s office for the paperwork.  Joe Palmer asked who was going to do the filing.  Les Bergum stated that Patti in his office does that.  Mayor McBarnes stated that Charity at the Police Department and Patti in Les’ office will work on this as a team.  David Hussey asked if someone new will be hired to do this.   Mayor McBarnes stated that they are not planning to at this time.  Steve Beardsley made a motion to pass Ordinance 19-06 on the First Reading.  Clarence Warthan seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Ordinance 19-06 passed on the First Reading.  Chief Bacon thanked the Council for changing the ordinances and that bringing the Code Enforcement to the police department has been successful.

OLD BUSINESS:    Nothing reported

NEW BUSINESS:      Redevelopment Authority annual report was presented.  Mayor McBarnes stated that this report has to come before the Council by April l5th.   Joe Palmer, RDA President, stated that the report breaks down the information for Bond A and Bond B for the Prairie Creek Park Project.

ADJOURNMENT:   There being no further business to come before the Council, Jim Moyer made a motion to adjourn.   Joe Palmer seconded the motion.  Mayor McBarnes adjourned the meeting.
