Common Council Meeting Minutes – January 14, 2019

The Common Council met in a regular meeting on January 14, 2019 in the Council Chambers, 301 East Clinton Street, Frankfort, Indiana at 7:00 PM.

Mayor Chris McBarnes called the meeting to order, and led the assembly in the Pledge of Allegiance.  David Hussey then prayed. Upon roll call the following members were present:   Jim Moyer, Eric Woods, David Hussey, Clarence Warthan, Steve Beardsley, Joe Palmer, and Lewis Wheeler.  Also present: Judith Sheets, Clerk-Treasurer and Les Bergum, City Attorney.

MINUTES:   The minutes for the December 10, 2018 regular meeting were presented.  Clarence Warthan made the motion to approve the minutes from the December 10, 2018 regular meeting.   David Hussey seconded the motion.   Upon roll call vote six “ayes” – Eric Woods, David Hussey, Clarence Warthan, Steve Beardsley, Lewis Wheeler, Jim Moyer and one “abstain” –  Joe Palmer were recorded.  Motion passed.

PUBLIC COMMENTS:   No comments.

ORDINANCE 18-13:   AN ORDINANCE AMENDING SECTION 73.24(B) OF THE MUNICIPAL CODE.  Police Chief Troy Bacon spoke on Ordinance 18-13, 18-14, and 18-15.  Chief Bacon stated that this is so any Code Enforcement Officer can enforce parking.  Eric Woods made a motion to suspend the rules and pass Ordinance 18-13on the Second and Third Reading.  Steve Beardsley seconded the motion.  Upon roll call vote seven”ayes” were recorded.  Motion passed.  Steve Beardsley made a motion to pass Ordinance 18-13 on the Second and Third Reading.  Clarence Warthan seconded the motion.  Ordinance 18-13 passed on the Second and Third Reading.

ORDINANCE 18-14:  (REVISED) AN ORDINANCE AMENDING SECTION 72.21(B) OF THE MUNICIPAL CODE.  Joe Palmer made a motion to suspend the rules and pass Ordinance 18-14 on the Second and Third Reading.  Eric Woods seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Motion passed.  Joe Palmer made a motion to pass Ordinance 18-14 on the Second and Third Reading.  Clarence Warthan seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Ordinance 18-14 passed on the Second and Third Reading.

ORDINANCE 18-15:   (REVISED) AN ORDINANCE AMENDING CHAPTER 72 OF THE MUNICIPAL CODE BY ADDING SECTION 72.24 REGARDING ENFORCEMENT.   Police Chief Troy Bacon stated that this would add Section 72.24 in Chapter 72 and it has to do with enforcement of parking.  Eric Woods made a motion to pass Ordinance 18-15 on the Second Reading.  Steve Beardsley seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Ordinance 18-15 passed on the Second Reading.

ORDINANCE 19-01:   AN ORDINANCE AMENDING AND RESTATING ORDINANCE NO. 18-10; SETTING THE SALARIES AND HOURLY WAGES FOR EMPLOYEES OF THE CIVIL CITY OF FRANKFORT, INDIANA.  Joe Palmer made a motion to read Ordinance 19-01 by title only.  Clarence Warthan seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Motion passed.  Ordinance 19-01 was read by title only.  Jack Dodd, Human Resource Director, that there was a correction to the Fire Pension Secretary and the Police Pension Secretary so that it shows the salary as an annual salary and not monthly.  Jack also stated that the Court Bailiff had been left off the salary ordinance and needed to be added.  Eric Woods made a motion to suspend the rules and pass Ordinance 19-01 on the First, Second, and Third Reading.  Steve Beardsley seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Motion passed.  Steve Beardsley made a motion to pass Ordinance 19-01 on the First, Second, and Third Reading.  Joe Palmer seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Ordinance 19-01 passed on the First, Second, and Third Reading.

RESOLUTION 19-01:    A RESOLUTION APPROVING PAYMENT IN LIEU OF TAXES TO CITY OF FRANKFORT FROM FRANKFORT UTILITY SERVICE BOARD FOR THE 2018 TAX YEAR.  Les Bergum stated that this is for the PILOT for taxes 2018 payable 2019.   The $400,000 will be paid in quarterly payments of $100,000.  Jim Moyer made a motion to pass Resolution 19-01.  Clarence Warthan seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Resolution 19-01 passed.

RESOLUTION 19-02:    A RESOLUTION DIRECTING TRANSFER OF APPROPRIATED FUNDS.  Judy Sheets, Clerk-Treasurer, asked that the Council approve a transfer from Professional Services to Part-time Labor in the amount of $5000.  Eric Woods made a motion to pass Resolution 19-02.  Joe Palmer seconded the motion.   Upon roll call vote seven “ayes” were recorded.  Resolution 19-02 passed.

RESOLUTION 19-03:   A RESOLUTION APPROVING PAYMENT IN LIEU OF TAXES TO CITY OF FRANKFORT FROM FRANKFORT UTILITY SERVICE BOARD.   Les Bergum stated that this resolution is for PILOT for taxes 2019 payable 2020.  The annual amount will be $350,000 which will be paid quarterly at $87,500.   Mayor McBarnes stated that the committee had worked hard on this.  Les stated that this terminates any verbal agreements on City salaries.  Steve Beardsley stated that the pension is a big factor for this amount.  Steve Beardsley made a motion to pass Resolution 19-03.  David Hussey seconded the motion.  Upon roll call vote seven “ayes” were recorded.  Resolution 19-03 passed.

OLD BUSINESS:    Jim Moyer presented the Council Committees for 2019.  Jim stated that he and the Mayor had met to come up with the committees.  Jim stated that they needed to appoint a Council member to the Economic Development Commission.  Joe Palmer made a motion to appoint David Hussey to the Economic Development Commission.  Jim Moyer seconded the motion.  Upon roll call vote six “ayes” – Eric Woods, Joe Palmer, Clarence Warthan, Steve Beardsley, Lewis Wheeler, Jim Moyer and one “abstain” – David Hussey.  Motion passed.

NEW BUSINESS:    Redevelopment Commission appointment.  Joe Palmer stated that he and Todd Corrie were the current council appointments to the Redevelopment Commission.  Clarence Warthan made a motion to appoint Joe Palmer and Todd Corrie to the Redevelopment Commission as council appointments.  Steve Beardsley seconded the motion.  Upon roll call vote six “ayes” – Eric Woods, David Hussey, Clarence Warthan, Steve Beardsley, Lewis Wheeler, Jim Moyer, and one “abstain” – Joe Palmer.  Motion passed.

Mayor McBarnes stated that Eric Woods would like to have the Finance Committee meet to discuss unspent 2018 appropriations and to transfer to the Rainy Day Fund.  Mayor McBarnes stated he would also like to discuss tax abatements for property owners.

Council President ProTem.   Joe Palmer made a motion to nominate Jim Moyer as President Pro Tem of the Council.  Clarence Warthan seconded the motion.  Upon roll call vote six “ayes” – Eric Woods, David Hussey, Joe Palmer, Clarence Warthan, Steve Beardsley, Lewis Wheeler, and one “abstain” – Jim Moyer.  Motion passed.

ADJOURNMENT:   There being no further business to come before the Council, David Hussey made a motion to adjourn.   Joe Palmer seconded the motion.  Mayor McBarnes adjourned the meeting.
