Common Council Meeting Minutes – Monday, September 23, 2013

Regular Meeting, Common Council, Council Chambers, 301 East Clinton Street, Frankfort, IN 46041, Monday, September 23, 2013, 7:00 p.m.

The Common Council met in a regular meeting on September 23, 2013 in the Council Chambers, 301 East Clinton Street, Frankfort, Indiana at 7:00 PM and the following action was taken: Mayor Chris McBarnes called the meeting to order, and led the assembly in the Pledge of Allegiance. Mayor McBarnes then prayed. Upon roll call the following members were present: Jim Moyer, Sam Paul, Jake Myers, Eric Woods, Josh Uitts, and Joe Palmer. Also present Les Bergum, City Attorney and Judy Sheets, Clerk-Treasurer.

MINUTES

The minutes for the September 9, 2013 regular meeting were presented. Joe Palmer made a motion to approve the minutes from the September 9, 2013 regular meeting. Josh Uitts seconded the motion. Upon roll call vote six “ayes” were recorded. Motion passed.

ORDINANCE 13-09: AN ORDINANCE VACATING A PUBLIC ALLEY. Jim Moyer made a motion to suspend the rules and pass Ordinance 13-09 on the second and third readings. Jake Myers seconded the motion. Upon roll call vote six “ayes” were recorded. Motion passed. Jim Moyer made a motion to pass Ordinance 13-09 on the second and third readings. Jake Myers seconded the motion. Upon roll call vote six “ayes” were recorded. Ordinance 13-09 passed on the second and third readings.

ORDINANCE 13-10: AN ORDINANCE AMENDING THE ZONING ORDINANCE MAP OF THE CITY OF FRANKFORT.

Joe Palmer made a motion to suspend the rules and pass Ordinance 13-10 on the second and third readings. Jim Moyer seconded the motion. Upon roll call vote six “ayes” were recorded. Motion passed. Eric Woods made a motion to pass Ordinance 13-10 on the second and third readings. Josh Uitts seconded the motion. Upon roll call vote six “ayes” were recorded. Ordinance 13-10 passed on the second and third readings.

ORDINANCE 13-11: AN ORDINANCE AMENDING DOWNTOWN PARKING ORDINANCE.

By consensus Ordinance 13-11 remained tabled.

ORDINANCE 13-12: ORDINANCE FOR APPROPRIATIONS AND TAX RATE.

Jim Moyer made a motion to read Ordinance 13-12 by title only. Josh Uitts seconded the motion. Upon roll call vote six “ayes” were recorded. Motion passed. Ordinance 13-12 was read by title only. Jim Moyer made a motion to pass Ordinance 13-12 on the first reading. Josh Uitts seconded the motion. Upon roll call vote six “ayes” were recorded. Ordinance 13-12 passed on the first reading.

ORDINANCE 13-13: AN ORDINANCE SETTING THE SALARIES AND HOURLY WAGES FOR EMPLOYEES OF THE CIVIL CITY OF FRANKFORT, INDIANA.

Eric Woods made a motion to read Ordinance 13-13 by title only. Jake Myers seconded the motion. Upon roll call vote six “ayes” were recorded. Ordinance 13-13 was read by title only. Joe Palmer made a motion to pass Ordinance 13-13 on the first reading. Sam Paul seconded the motion. Upon roll call vote six “ayes” were recorded. Ordinance 13-13 passed on the first reading.

ORDINANCE 13-14: AN ORDINANCE ESTABLISHING THE SALARIES OF THE ELECTED OFFICIALS OF THE CITY OF FRANKFORT, INDIANA.

Jake Myers made a motion to read Ordinance 13-14 by title only. Sam Paul seconded the motion. Upon roll call vote six “ayes” were recorded. Ordinance 13-14 was read by title only. Jake Myers made a motion to pass Ordinance 13-14 on first reading. Eric Woods seconded the motion. Upon roll call vote six “ayes” were recorded. Ordinance 13-14 was passed on first reading.

RESOLUTION 13-14: A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF FRANKFORT, INDIANA APPROVING CERTAIN MATTERS IN CONNECTION WITH THE PHASE II: FRANKFORT ECONOMIC DEVELOPMENT AREA.

Jim Moyer made a motion to pass Resolution 13-14. Joe Palmer seconded the motion. Mayor McBarnes stated that Bruce Donaldson and Mike Shaver were present at the meeting. Eric Woods asked Mr. Shaver if any of the changes needed explanations as far as the tax allocation areas and maps. Mike Shaver stated that the line connecting at LEP is widening. Eric Woods asked if there were more changes anticipated. Mike Shaver stated that this is the third step of a four step process. Eric stated that he appreciated the red line version that he received. Bruce Donaldson stated that if this is approved that a notice will be published and it will go back to the RDC and they will confirm it and all tax units will be notified of the TIF area. Upon roll call vote six “ayes” were recorded. Resolution 13-14 passed.

RESOLUTION 13-15: A RESOLUTION APPROVING ADOPTION OF EMERGENCY MUTUAL AID AGREEMENT.

Jake Myers made a motion to pass Resolution 13-15. Eric Woods seconded the motion. Les Bergum stated that the EMA had an approved first draft of the agreement and it had to be an inter-local agreement, so he had prepared the Resolution and the inter-local agreement. Upon roll call vote six “ayes” were recorded. Resolution 13-15 passed.

OLD BUSINESS

Eric Woods stated that the Economic Development Plan had passed and he would like to bring up the extra charge and if there is anything that could be done to get this reduced. Eric stated that he felt that the cost of the presentation of the plan should have been included and he would like to see some effort to reduce this. Mayor McBarnes asked what part that he did not agree with. Eric stated that he did not think that should have been above and beyond and that Mike Shave should have done the presentation as part of it. Eric stated that he was asking that the Board of Works looks at this and see if some work can be done to reduce this. Jake Myers stated that we could not expect the council representative to come back and present the information. Jake stated that the presentation should have been a part of it.

NEW BUSINESS

It was announced that the next meeting will be held on Tuesday, October 15th due to the Columbus Day Holiday on October 14th.

There being no further business to come before the Council Jim Moyer made a motion to adjourn the meeting. Joe Palmer seconded the motion. Meeting adjourned.
