Common Council Meeting Minutes – Monday, March 11, 2013

Regular Meeting, Common Council, Council Chambers, 301 East Clinton Street, Frankfort, IN 46041, Monday, March 11, 2013, 7:00 p.m.

The Common Council met in a regular meeting on March 11, 2013 in the Council Chambers, 301 East Clinton Street, Frankfort, Indiana at 7:00 PM and the following action was taken: Mayor Chris McBarnes called the meeting to order, and led the assembly in the Pledge of Allegiance. Mayor McBarnes then prayed. Upon roll call the following members were present: Jim Moyer, Sam Paul, Jake Myers, Rick Gunyon, Eric Woods, and Josh Uitts. Also present Les Bergum, City Attorney and Judy Suter, Clerk-Treasurer. Absent: Joe Palmer

MINUTES

The minutes for the February 25, 2013 regular meeting were presented. Jim Moyer made a motion to approve the minutes from the February 11, 2013 regular meeting. Rick Gunyon seconded the motion. Upon Roll Call vote six “ayes” were recorded. Motion passed.

ORDINANCE 13-05: AN ORDINANCE AMENDNING 155.230 OF THE ZONING CODE OF FRANKFORT TO EXTEND BOUNDARIES OF DOWNTOWN FRANKFORT HISTORIC OVERLAY DISTRICT.

Jim Moyer made a motion to read Ordinance 13-05 by title only. Jake Myers seconded the motion. Upon roll call vote six “ayes” were recorded. Ordinance 13-05 was read by title only. Les Bergum stated that this ordinance is to extend the Frankfort Historic Overlay District and that a map was attached. Les stated that the City Plan Commission had passed a resolution and recommended that the Council enact an ordinance amending the geographical area of the Downtown Frankfort Historic Overlay District. Mayor McBarnes stated that the main driving force behind this is the speed at which some businesses are moving and that we hold them to standards that we are happy with. Josh Uitts made a motion to suspend the rules and pass Ordinance 13-05 on the first, second, and third reading. Rick Gunyon seconded the motion. Upon roll call vote six “ayes” were recorded. Motion passed. Eric Woods made a motion to pass Ordinance 13-05 on the first, second, and third reading. Josh Uitts seconded the motion. Upon roll call vote six “ayes” were recorded. Ordinance 12-05 was passed on the first, second, and third reading.

NEW BUSINESS

Mayor McBarnes stated that Tuesday, March 12th at the Farmers Bank CEAF will be opening the bids for the private project for Ivy Tech. Les Bergum spoke on the Ivy Tech Parking Lot project, and stated that on March 14th at 9:00 AM at the Library there will be a Common Construction Wage Hearing.

OLD BUSINESS

Jake Myers stated that he had been researching an ordinance for bow and arrows being used in the city. Discussion followed. Jake stated that he would like to meet with the councilmatic and Les Bergum on this.

Rick Gunyon stated that he had provided Les Bergum with some data as far as property owners not receiving a storm water bill. Les stated that he had just received the information and would like to check with the Assessor’s office. Les stated that these people need to receive a written notice and a public notice has to be published 10 days before the hearing. Les stated that he would like to go with the 1st meeting in April for the Public Hearing and 2nd reading of the Ordinance.

It was announced that the regular work session will be held on March 25th, and to get any topics to the Clerk-Treasurer the Wednesday before the meeting.

There being no further business to come before the Council Jim Moyer made a motion to adjourn. Jake Myers seconded the motion. Motion was approved by unanimous voice vote. Meeting adjourned.
