Common Council Minutes – August 13, 2012

The Common Council met in a regular meeting on August 13, 2012 in the Council Chambers, 301 East Clinton Street, Frankfort, Indiana at 7:00 PM and the following action was taken: Mayor Chris McBarnes was present, called the meeting to order, and led the assembly in the Pledge of Allegiance. Mayor Chris McBarnes then prayed. Upon roll call the following members were present: Jim Moyer, Sam Paul, Jake Myers, Rick Gunyon, Eric Woods, Joe Palmer and Josh Uitts. Also present Les Bergum, City Attorney and Judy Suter, Clerk-Treasurer.

MINUTES:

The minutes for the July 23, 2012 meeting were presented. Jim Moyer made a motion to approve the minutes from July 23, 2012. Eric Woods seconded the motion. Upon roll call vote six “ayes” – Sam Paul, Eric Woods, Jake Myers, Rick Gunyon, James Moyer, Joe Palmer, and one “abstain” – Josh Uitts were recorded. Motion passed.

ORDINANCE 12-05: AN ORDINANCE AMENDING ORDINANCE NO. 11-01A AS TO DOWNTOWN PARKING:

Joe Palmer made a motion to take Ordinance 12-05 off the table. Jake Myers seconded the motion. Les Bergum stated that there was no A and it only showed as being revised on August 13, 2012. Les stated that the change made was the third violation was raised from $60 to $250. Discussion followed as to whether the Ordinance was ready to be voted on. Motion died.

ORDINANCE 12-07: AN ORDINANCE ESTABLISHING THE SALARIES OF THE ELECTED OFFICIALS OF THE CITY OF FRANKFORT, INDIANA:

Joe Palmer made a motion to read Ordinance 12-07 by title only and pass on the First Reading. Jim Moyer seconded the motion. Jim Moyer asked about the date that the ordinance had to be passed by and if it should be tabled. Discussion followed. Joe Palmer withdrew his motion. Jim Moyer withdrew his second. Jim Moyer made a motion to table Ordinance 12-07 until the next meeting. Joe Palmer seconded the motion. Upon roll call vote seven “ayes” were recorded. Motion passed.

ORDINANCE 12-08: AN ORDINANCE SETTING THE SALARIES AND HOURLY WAGES FOR EMPLOYEES OF THE CIVIL CITY OF FRANKFORT, INDIANA:

Eric Woods made a motion to table Ordinance12-08 for the same reasons as Ordinance 12-07. Josh Uitts seconded the motion. Upon roll call vote seven “ayes” were recorded. Motion passed.

ORDINANCE 12-09: AN ORDINANCE AMENDING AND RESTATING SECTIONS 96.25 THROUGH 96.291 OF THE MUNICIPAL CODE REGARDING WEEDS AND GRASS HEIGHT:

Eric Woods made a motion to read Ordinance 12-09 by title only. Joe Palmer seconded the motion. Upon roll call vote seven “ayes” were recorded. Motion passed. Ordinance 12-09 was read by title only. Jim Moyer made a motion to pass Ordinance 12-09 on First Reading. Rick Gunyon seconded the motion. Les Bergum stated that the General Assembly had passed new laws concerning weed liens as follows: first notices have to go by certified mail, repeat notices do not have be sent by mail, definition of weeds and vegetation and height. Rick Gunyon stated that some of the vegetation listed was misspelled. Les stated that would be changed. Upon roll call vote seven “ayes” were recorded. Ordinance 12-09 passed on First Reading.

RESOLUTION 12-06: A RESOLUTION DIRECTING FILING OF PERITION FOR APPROVAL OF RATE AND CHARGE DIFFERENCE BETWEEN PROPERTY WITHIN AND PROPERTY OUTSIDE THE CORPORATE BOUNDARIES OF FRANKFORT:

Jim Moyer made a motion to pass Resolution 12-06. Jake Myers seconded the motion. Les Bergum stated that Jeff Rowe of Umbaugh had contacted him about this legislation and that a petition has to be filed with the URC. Upon roll call vote seven “ayes” were recorded. Resolution 12-06 passed.

NEW BUSINESS:

Nothing reported.

OLD BUSINESS:

The Clerk-Treasurer asked about setting another time for budget hearings to finish up the 2013 Budget. It was decided to meet on Monday August 20th at 6:30 PM in the Council Chambers.

 ADJOURNMENT:

There being no further business to come before the Council Jake Myers made a motion to adjourn. Josh Uitts seconded the motion. Upon roll call vote seven “ayes” were recorded. Meeting adjourned.
