Common Council – February 27, 2012

The Common Council met in a regular meeting on February 27, 2012 in the Council Chambers, 301 East Clinton Street, Frankfort, Indiana at 7:00 PM and the following action was taken: Mayor Chris McBarnes was present, called the meeting to order, and led the assembly in the Pledge of Allegiance. Mayor Chris McBarnes then prayed. Upon roll call the following members were present: Sam Paul, Jim Moyer, Eric Woods, Joe Palmer, Josh Uitts, Jake Myers, and Rick Gunyon. Also present Les Bergum, City Attorney and Judy Suter, Clerk-Treasurer.

MINUTES:

The minutes for the February 13, 2012 meeting were presented. Joe Palmer made a motion to approve the minutes from February 13, 2012. Sam Paul seconded the motion. Upon roll call vote seven “ayes” were recorded. Motion passed.

ORDINANCE 12-03: AN ORDINANCE AMENDING ORDINANCE NO. 75-10 REGARDING APPOINTMENTS TO UTILITY SERVICE BOARD.

Eric Woods made a motion to amend Section 2, sentence 3 add “elected” before public office. Joe Palmer seconded the motion. Upon roll call vote seven “ayes” were recorded. Motion passed. Jim Moyer made a motion to amend Section 2, line 4, replace any with “electric, water, sewage, all three services”. Sam Paul seconded the motion. Discussion followed. Upon roll call vote three “ayes” – Sam Paul, Joe Palmer, Jim Moyer, and four “nays” – Eric Woods, Josh Uitts, Jake Myers, Rick Gunyon were recorded. Motion did not pass. Eric Woods made a motion to pass Ordinance 12-03 on Second Reading as amended. Rick Gunyon seconded the motion. Upon roll call vote five “ayes” – Sam Paul, Eric Woods, Josh Uitts, Jake Myers, Rick Gunyon, and two “nays” – Joe Palmer, Jim Moyer were recorded. Ordinance 12-03 passed on Second Reading as amended.

ORDINANCE 12-04: AN ORDINANCE REGULATING THE USE OF GOLF CARTS.

Jim Moyer made a motion to read Ordinance 12-04 by title only. Joe Palmer seconded the motion. Upon roll call vote seven “ayes” were recorded. Motion passed. Ordinance 12-04 was read by title only. Jim Moyer made a motion to pass Ordinance 12-04 on the First Reading. Joe Palmer seconded the motion. Discussion followed. Jim Moyer stated that Section 5 should include State Road 75. Jake Myers presented statistics on injuries and deaths related to golf carts. Sam Paul asked about the city’s liability. Les Bergum stated that he wouldn’t think that they would be. Police Chief Troy Bacon stated he wouldn’t comment on it until he sees the ordinance. Mayor McBarnes stated that he had received calls on driving golf carts in the City. Upon roll call vote five “ayes” – Sam Paul, Eric Woods, Joe Palmer, Josh Uitts, Jim Moyer, and two “nays” – Jake Myers, Rick Gunyon were recorded. Ordinance 12-04 passed on First Reading.

ORDINANCE 12-05: AN ORDINANCE AMENDING ORDINANCE NO. 11-01A AS TO DOWNTOWN PARKING.

Joe Palmer made a motion to read Ordinance 12-05 by title only. Eric Woods seconded the motion. Upon roll call vote seven “ayes” were recorded. Motion passed. Ordinance 12-05 was read by title only. Discussion followed. Mayor McBarnes stated that Stacy Uitts, Billing Office Manager, stated at the last Utility Service Board meeting she was ok with the change to two parking spaces in front of the billing office. Joe Palmer stated that he had merchants say to go from three hour parking to two hour parking. Mayor McBarnes stated that he would have the Street Committee solicit more information on this. Joe Palmer made a motion to pass Ordinance 12-05 on the First Reading. Jake Myers seconded the motion. Upon roll call vote six “ayes” – Sam Paul, Eric Woods, Joe Palmer, Josh Uitts, Jake Myers, Rick Gunyon, and one “nay” – Jim Moyer. Ordinance 12-05 passed on the First Reading.

NEW BUSINESS:

Mayor McBarnes stated that the Council Redevelopment Commission appointments need to be made. Eric Woods stated that he would recommend that a Council member be named as one of the appointments. Eric Woods made a motion to appoint Rick Gunyon as the Council member on the Redevelopment Commission. Jake Myers seconded the motion. Upon roll call vote six “ayes” – Sam Paul, Eric Woods, Joe Palmer, Josh Uitts, Jake Myers, Jim Moyer and one “abstained” – Rick Gunyon. Motion passed.
Sam Paul made a motion to appoint Robert Shaffer to the Redevelopment Commission. Josh Uitts seconded the motion. Upon roll call vote seven “ayes” were recorded. Motion passed. Rick Gunyon asked if they could by consensus have the Clerk-Treasurer send out thank you letters to the applicants for the Redevelopment Commission.
Carol Price presented information on the Complete Street Program. This program is to enable safe access for all pedestrians, bicyclist, public transportation users and motorists. Dr. Steve Tharp commented on the Complete Street Program and stated that this would make our community more attractive. Mayor McBarnes thanked Carol Price and Dr. Tharp, and stated that he is excited about the program and feels it would be a good opportunity for the City.

OLD BUSINESS:

Mayor McBarnes asked Police Chief Troy Bacon about the stop signs at Rossville and Monon. Police Chief Bacon stated that during the time of the survey only one train went through. Police Chief Bacon stated that he would recommend doing a couple more surveys. Joe Palmer agreed with Police Chief Bacon that more surveys were needed.

ADJOURNMENT:

There being no further business to come before the Council Jim Moyer made a motion to adjourn. Joe Palmer seconded the motion. Motion was approved by unanimous voice vote. Meeting adjourned.
