City Council Meeting Minutes – July 9, 2018

The Common Council met in a regular meeting on July 9, 2018 in the Council Chambers, 301 East Clinton Street, Frankfort, Indiana at 7:00 PM.

President Pro Tem James Moyer called the meeting to order, and led the assembly in the Pledge of Allegiance. Clarence Warthan then prayed. Upon roll call the following members were present:   Jim Moyer, Eric Woods, Wanda Mitchell, Clarence Warthan, Steve Beardsley, Lewis Wheeler, and Joe Palmer. Also present: Judith Sheets, Clerk-Treasurer and Les Bergum, City Attorney. Absent: Mayor Chris McBarnes.

MINUTES:   The minutes for the June 25, 2018 regular meeting were presented. Steve Beardsley made the motion to approve the minutes from the June 25, 2018 regular meeting. Lewis Wheeler seconded the motion.  Upon roll call vote seven “ayes” were recorded. Motion passed.   The Memorandum and Certification of Executive Session from June 25, 2018 was presented.   Eric Woods made a motion to approve the Memorandum of Executive Session. Wanda Mitchell seconded the motion. Upon roll call vote seven “ayes” were recorded. Motion passed.

PUBLIC COMMENTS:   No Comments

Jim Moyer recessed the Council meeting at 7:03PM and opened the Public Hearing on Ordinance 18-03.

PUBLIC HEARING:   Public Hearing on Ordinance 18-03, an Ordinance to Amend the Sewer Rates and Charges for the City of Frankfort, Indiana.   There were no questions or comments made during the Public Hearing.

Jim Moyer closed the Public Hearing at 7:05 PM and opened the Council meeting.

ORDINANCE 18-03:   AN ORDINANCE TO AMEND THE SEWER RATES AND CHARGES FOR THE CITY OF FRANKFORT, INDIANA. Joe Palmer made a motion to pass Ordinance 18-03 on Third Reading. Clarence Warthan seconded the motion. Upon roll call vote five “ayes” – Wanda Mitchell, Joe Palmer, Clarence Warthan, Steve Beardsley, Jim Moyer and two “nays” – Eric Woods and Lewis Wheeler.   Ordinance 18-03 passed on the Third Reading.

ORDINANCE 18-04:   AN ORDINANCE AUTHORIZING THE ACQUISITION, CONSTRUCTION AND INSTALLATION OF CERTAIN IMPROVEMENTS TO THE SEWAGE WORKS SYSTEM OF THE CITY OF FRANKFORT, INDIANA, THE ISSUANCE OF REVENUE BONDS TO PROVIDE FOR THE COAST THEREOF, THE COLLECTION, SEGREGATION AND DISTRIBUTION OF THE REVENUES OF SUCH SYSTEM, THE SAFEGUARDING OF THE INTERESTS OF THE OWNER OF SUCH REVENUE BONDS,

AND OTHER MATTERS CONNECTED THEREWITH, AND REPEALING ORDINANCES INCONSISTENT HEREWITH. Steve Beardsley made a motion to pass Ordinance 18-04 on the Third Reading. Joe Palmer seconded the motion.   Upon roll call vote five “ayes” – Wanda Mitchell, Joe Palmer, Clarence Warthan, Steve Beardsley, Jim Moyer, and two “nays” – Eric Woods, Lewis Wheeler. Ordinance 18-04 passed on Third Reading.

ORDINANCE 18-05:   AN ORDINANCE VACATING AN ALLEY IN THE WOODSIDE ADDITION OF THE CITY OF FRANKFORT, INDIANA. Eric Woods made a motion to read Ordinance 18-05 by title only. Clarence Warthan seconded the motion. Upon roll call vote seven “ayes” were recorded. Motion passed. Ordinance 18-05 was read by title only. Phil Triplett was present at the meeting to represent P&K Rentals, LLC to petition for vacating an alley in the Woodside addition east of Magnolia Avenue. Phil stated that Bell Machine is expanding operations and need this for more parking. Phil stated that there will be a Public Hearing at the next meeting. Steve Beardsley made a motion to pass Ordinance 18-05 on the First Reading. Clarence Warthan seconded the motion. Upon roll call vote seven “ayes” were recorded. Ordinance 18-05 passed on the First Reading.

OLD BUSINESS:   Eric Woods passed out a draft policy for Non-Profit Organization funding for Council review. Eric stated that after the Council reviews it and makes any edits that Les will put it in a Resolution. Discussion followed. Eric suggested that any edits be done by the next meeting.

NEW BUSINESS: Nothing reported.

ADJOURNMENT:   There being no further business to come before the Council, Joe Palmer made a motion to adjourn. Clarence Warthan seconded the motion. Mayor McBarnes adjourned the meeting.
