City Council Meeting Minutes – March 27, 2017

The Common Council met in a regular meeting on March 27, 2017 in the Council Chambers, 301 East Clinton Street, Frankfort, Indiana at 7:00 PM and the following action was taken: Mayor Chris McBarnes called the meeting to order, and led the assembly in the Pledge of Allegiance. Lewis Wheeler then prayed. Upon roll call the following members were present: Joe Palmer, Eric Woods, Clarence Warthan, Wanda Mitchell and Lewis Wheeler. Also present: Les Bergum, City Attorney and Judy Sheets, Clerk-Treasurer. Absent: Jim Moyer

MINUTES: The minutes for the March 13, 2017 regular meeting and the March 13, 2017 special meeting were presented. Lewis Wheeler made a motion to approve the minutes from the March 13, 2017 regular meeting and the March 13, 2017 special meeting. Joe Palmer seconded the motion. Upon roll call vote five “ayes” were recorded. Motion passed 5-0.

PUBLIC COMMENTS: There were no public comments.

ORDINANCE 17-04: AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF FRANKFORT, INDIANA, AUTHORIZING THE ISSUANCE OF THE CITY OF FRNKFORT, INDIANA ECONOMIC DEVELOPMENT REVENUE BONDS, SERIES 2017 (IRON MEN PROJECT), AND THE USE OF THE PROCEEDS THEREOF TO SUPPORT THE IRON MEN PROJECT, AND AUTHORIZING OTHER ACTIONS IN RESPECT THERETO. Wanda Mitchell made a motion to pass Ordinance 17-04 on the Third Reading. Clarence Warthan seconded the motion. Upon roll call vote five “ayes” were recorded. Ordinance 17-04 passed on the Third Reading.

ORDINANCE 17-05: AN ORDINANCE AMENDING CHAPTER 90 OF THE MUNICIPAL CODE OF THE CITY OF FRANKFORT RELATING TO ANIMALS AND ANIMAL CONTROL. Eric Woods made a motion to read Ordinance 17-05 by title only. Wanda Mitchell seconded the motion. Upon roll call vote five “ayes” were recorded. Ordinance 17-05 was read by title only. Eric Woods stated that this was discussed at the last meeting and that we want to be sure that we split the fees correctly. Eric asked that Les and the Clerk-Treasurer check into this. Clarence Warthan stated that he would like to take a look at 2. (2) concerning the 32 degrees as he felt that was too invasive. Wanda Mitchell made a motion to table Ordinance 17-05. Eric Woods seconded the motion. Upon roll call vote five “ayes” were recorded. Ordinance 17-05 was tabled.

ORDINANCE 17-06: AN ORDINANCE AMENDING WATER AND SEWER RATES TO ELIMINATE A SYSTEM CAPACITY CHARGE. Joe Palmer made a motion to suspend the rules and pass Ordinance 17-06 on the Second and Third Reading. Eric Woods seconded the motion. Upon roll call vote five “ayes” were recorded. Motion passed. Joe Palmer made a motion to pass Ordinance 17-06 on the Second and Third Reading. Eric Woods seconded the motion. Upon roll call vote five “ayes” were recorded. Ordinance 17-06 passed on the Second and Third Reading.

RESOLUTION 17-05: A RESOLUTION APPROVING FRANKFORT AND CLINTON COUNTY BICYCLE AND PEDESTRIAN MASTER PLAN AND AMENDING THE CITY OF FRANKFORT 2035 COMPREHENSIVE PLAN TO INCLUDE SUCH MASTER PLAN AS A COMPONENT THEREOF. Mayor McBarnes stated that this resolution was tabled at the last Council meeting. Mayor McBarnes stated that this was discussed at the City Plan Commission meeting. Lewis Wheeler made a motion to take Resolution 17-05 off the table. Joe Palmer seconded the motion. Upon roll call vote five “ayes” were recorded. Resolution 17-05 was taken off the table. Joe Palmer stated that he had calls from constituent with concerns because of what recently happened in Delphi. Carol Price stated that they are asking for the plan to be a part of the comprehensive plan and that right now it is just a plan for walking and bicycling. Lewis Wheeler stated that as we go along we will have to figure out between the City and County working together and that we should be able to work it out. Larry Price also spoke about the plan and stated that they will have to come back about the lights and signs. Joe Palmer made a motion to pass Resolution 17-05. Clarence Warthan seconded the motion. Upon roll call vote five “ayes” were recorded. Resolution 17-05 passed.

RESOLUTION 17-06: A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF FRANKFORT, INDIANA APPROVING CERTAIN MATTERS IN CONNECTION WITH THE AMENDMENT OF AN ECONOMIC DEVELOPMENT AREA AND PLAN. Les Bergum stated that this would approve the Declaratory Resolution was passed by the Redevelopment Commission. Les stated that this would pick up some of the areas in downtown, and stated that there are maps and exhibits attached. Les stated that the Economic Development Commission had met and had a public hearing and the Redevelopment Commission has a public hearing on April 10. Mayor McBarnes asked Joe Palmer his thoughts for Main Street. Joe Palmer stated that this broadens the TIF district and the Facade grants and that he felt it is a good thing. Eric Woods stated that the Finance Committee had met with Iron Men and had come up with an abatement schedule. Joe Palmer made a motion to pass Resolution 17-06. Wanda Mitchell seconded the motion. Upon roll call vote five “ayes” were recorded. Resolution 17-06 passed.

OLD BUSINESS: Nothing reported.

NEW BUSINESS: Eric Woods stated that Renee Crick would not be at the meeting to report on Central Dispatch, but will maybe be at the next meeting. Joe Palmer stated that the new street sweeper was in. Jason Forsythe reported that the street sweeper is an excellent machine and gave a report on it. Jason stated that they will be keeping the old one so that they will have two. Lewis Wheeler stated that there will be an Easter Egg Hunt at the TPA Park and that it is awesome with awesome prizes. Joe Palmer gave an update on the downtown sidewalks, lights, and trees.

ADJOURNMENT: There being no further business to come before the Council, Joe Palmer made a motion to adjourn. Clarence Warthan seconded the motion. Mayor McBarnes adjourned the meeting.
